Terms & Conditions

1. Introduction

1.1 These Terms & Conditions (“Terms”) form the contract between you (“you”, “your”) and The Scottish Tour Guide (“we”, “us”, “our”) in respect of any private tour or guiding service booked via our website or otherwise arranged.

1.2 By making a booking with us, you (and all members of your party) accept these Terms in full.

1.3 These Terms, together with your booking confirmation, represent the entire agreement between you and us.

2. Booking & Payment

2.1 To make a booking, you must provide your name, address, contact details, the names of all members of your party, any special requirements, and payment as required by us.

2.2 A non-refundable deposit (or full payment) may be required at the time of booking to reserve your tour date. The balance will be due no later than 35 days before the date of day tours or 63 days before multi-day tours (or immediately if booking is within that period).

2.3 All payments must be made in British Pounds (£ GBP) unless otherwise stated.

2.4 If the balance is not received by the due date, we reserve the right to cancel your booking and retain the deposit.

3. Changes and Cancellations by You

3.1 If you wish to change the date, time, itinerary or number of people in your party, you must notify us in writing (either letter or email) as soon as possible. We will endeavour to accommodate your request, but we cannot guarantee that the change will be possible. Additional charges may apply.

3.2 If you cancel your booking:

  • More than 35 days before the date of a day tour or 63 days before a multi-day tour: you will receive a refund of the balance paid (minus any non-refundable deposit or administration fee).

  • Less than 35 days before the date of a day tour or 63 days before a multi-day tour: no refund will be given (or only a partial refund as may be specified).


3.3 If you fail to join the tour at the agreed time or from the agreed pick-up point, we shall treat this as a cancellation by you and no refund will be given.

4. Changes and Cancellations by Us

4.1 We reserve the right to cancel or reschedule a tour in the event of insufficient participants (if applicable), adverse weather or road conditions, vehicle breakdown, or other “event outside our control” (see clause 9).

4.2 In the event of cancellation by us, we will notify you as soon as possible and offer you either:

  • an alternative date; or

  • a full refund of all monies paid.


4.3 We will not be liable for any additional costs you may incur (such as flights, accommodation, connecting tours) as a result of our cancellation or rescheduling.

5. Itinerary, Vehicle & Group Size

5.1 We will confirm the itinerary, departure time, pick-up location and group size in writing (email) when your booking is accepted.

5.2 You acknowledge that tour timings are approximate and subject to change due to traffic, weather, road conditions or other unforeseen events.

5.3 If you have specified a particular vehicle or guide, we will use reasonable efforts to satisfy your request, but reserve the right to substitute an equivalent vehicle or guide if necessary.

6. Your Responsibilities

6.1 You must ensure that you and all members of your party:

  • Are at the agreed pick-up point on time.

  • Have the correct travel documentation (passport, visa, etc.).

  • Are physically and mentally fit to participate in the tour.


6.2 You must advise us at the time of booking of any medical condition, disability or mobility limitation that may affect your participation in the tour.

6.3 You agree to comply with the reasonable instructions of your guide or driver at all times.

6.4 We reserve the right to refuse to carry any person whose behaviour is disruptive, offensive or puts at risk the safety or enjoyment of others; in that event, the contract will be treated as cancelled by you and no refund will be due.

7. Third-Party Suppliers

7.1 Some aspects of your tour may be provided by independent third-party suppliers (hotels, attractions, transport companies, etc.). These suppliers will have their own terms and conditions, and we cannot accept responsibility for their acts or omissions.

7.2 To the fullest extent permitted by law, our liability for their services is excluded under this contract.

8. Liability and Insurance

8.1 We will exercise reasonable skill and care in the provision of our services. However, except in respect of death or personal injury caused by our negligence, our liability is limited to the amount you paid for the tour.

8.2 We strongly recommend that you obtain appropriate travel, cancellation and personal accident insurance.

8.3 We do not accept liability for any loss, delay or damage arising from force majeure (see clause 9), your failure to obtain correct documentation, or any other circumstances beyond our control.

9. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under this contract if such failure or delay is caused by an event beyond our reasonable control, including (but not limited to) war, terrorism, civil commotion, natural disaster, fire, flood, adverse weather, vehicle breakdown, strikes, labour disputes, pandemic or epidemic, or the act of any government or authority.

10. Data Protection & Privacy

10.1 We will process your personal data in accordance with applicable data protection law and our Privacy Policy. By making a booking, you consent to our processing of your personal data for the purposes of administering your booking and keeping you informed of our services (unless you ask us not to).

10.2 You agree that we may collect and pass on your details (such as names, dietary requirements, medical information, etc.) to third-party suppliers strictly for the purposes of the tour.

11. Intellectual Property

All content on our website, including text, images, logos and designs, is our property (or that of our licensors) and may not be used or reproduced without our prior written consent.

12. Photography & Promotional Use

Occasionally, we may record photographs or video of tours. By participating, you consent to us using such imagery for marketing or promotional purposes unless you inform us in writing in advance.

16. Revision of Terms

We may revise these Terms from time to time. Any changes will apply to bookings made after the date of such change. You should check the version of the Terms in force at the time of your booking.
